Nankivell Conveyancing specialises in Form 1 preparation. 

When you are selling your property, you, as the vendor are responsible for providing a Form 1 Vendor’s Disclosure Statement to the potential purchaser. The Form 1 sets out everything the purchaser needs to be fully aware of in regards to the property, beyond the outside façade and beautiful presentation.

The Form 1 includes details about legal matters related to the property, including financing, leases, tenancies, rights of way over land, boundaries and fences, building works and other matters required by the Act that affect the property and title which need to be brought to the attention of the purchaser.

A Form 1 is required by law (Section 7 of the Land and Business (Sale and Conveyancing) Act 1994).

The document will include the details of both the vendor/s and the purchaser/s and the intended transaction, cooling off rights, a statement by or on behalf of the vendor/s and a certification by or on behalf of the agent as to the particulars contained in the document.

I/We instruct Nankivell Conveyancing to order all necessary searches and prepare the Form 1 Disclosure Statement for the sale contract as required under the current legislation and to deliver a Form 1 to the authorised agent for them to serve upon the Purchaser.

A Tax Invoice for the searches will be billed at within two (2) months of the date of this authority or upon settlement of the property, whichever is earlier.

Should there be any further registrations on the title, I understand that Nankivell Conveyancing is required to search said items and disclose any registered instrument at my expense. I undertake to pay any additional costs for such searches within two (2) months of the date of this authority or upon settlement of the property, whichever is earlier.

By providing these instructions & signing the completed Form 1 document, I/we are confirming that I/we are the registered owner(s) of the above land. I/we acknowledge that I/we are required to complete and sign the Form 1 Questionnaire and Payment Authority on this page and provide any relevant information in relation to the land to Robbins Forms for completion of the Form 1 on my/our behalf.

I/we acknowledge that this is an irrevocable order for payment to Nankivell Conveyancing and includes fees, charges and expenses for preparation and any searches ordered. I/we acknowledge that where I/we have not selected to pay the “deferred payment fee” of $55, I/we understand that full payment is due upon completion of this form. Where I/we have elected to engage Nankivell Conveyancing as my/our conveyancer to complete settlement, and pay the $55 “deferred payment fee” and sufficient funds are available on completion of settlement I/we acknowledge that Nankivell Conveyancing will deduct the fees, charges and expenses from the funds.

If a tax invoice is delivered due to insufficient funds at the time of settlement or where settlement does not take place within 90 days of preparation of the Form 1, I/we acknowledge that payment is to be made within 7 days of the date of invoice. If the tax invoice remains unpaid, I/we acknowledge that Nankivell Conveyancing reserve the right to take credit action. I/we acknowledge that Nankivell Conveyancing reserve the right at all times to suspend action on this matter if these arrangements have not been followed.

We wish to defer the cost of these payments to either 90 days from the date that the searches are ordered or until settlement, whichever is the earlier. I/We understand that a deferred payment fee of $55 will be applicable.
I/We confirm that we are engaging Nankivell Conveyancing to act as our Conveyancer for the preparation of the Form 1.
I hereby authorise Nankivell Conveyancing to act on my behalf in the subsequent transfer of the property identified above.
Do you require a quote for additional conveyancing services associated with sale of the property?
I acknowledge that if the property does not sell within 90 days or is withdrawn from the market, that I will be issued with an invoice for the government searches and Form 1 preparation and that this invoice will be paid within 7 days.
